PLEASE READ THESE TERMS OF SERVICE ("TERMS", "AGREEMENT") CAREFULLY BEFORE USING THE MILPERK PLATFORM. BY ACCESSING, BROWSING, OR CREATING AN ACCOUNT ON THIS PLATFORM, YOU AGREE TO BE UNCONDITIONALLY BOUND BY ALL TERMS, CONDITIONS, DISCLAIMERS, AND LIMITATIONS OF LIABILITY CONTAINED HEREIN.
1. Eligibility & Acceptance
Access to MilPerk ("Company", "Provider", "we", "us") is strictly limited to individuals who are at least eighteen (18) years of age or the age of legal majority in their jurisdiction. By accessing the Platform, you represent and warrant that you possess the full legal capacity to enter into a binding agreement.
2. Provider Platform Role & Verification Disclaimer
MilPerk operates strictly as an independent information aggregator, identity verification directory, and promotional referral directory. Provider is NOT a retailer, merchant, manufacturer, distributor, seller of record, or employer.
We do not issue commercial promo codes, establish merchant product prices, or manage merchant checkout engines. You acknowledge that merchant discount terms, code validity, percentage discounts, and eligibility requirements are established exclusively by third-party merchant partners and are subject to immediate modification or expiration without notice.
3. User Verification Integrity & Account Security
Access to gated community discounts (including military, educator, first responder, healthcare, government, student, or senior perks) requires valid identity status verification. You agree to provide truthful, accurate, and current information during the verification handshake.
Prohibited Fraudulent Conduct: Misrepresenting your employment status, forging credentials, utilizing stolen verification tokens, or attempting to unlock gated codes for unauthorized third parties constitutes a material breach of this Agreement and may result in immediate account termination, blacklisting, and civil referral.
4. FTC Affiliate Disclosure & Third-Party Referrals
In compliance with Federal Trade Commission (FTC) guidelines, please be advised that MilPerk maintains commercial affiliate relationships with certain merchant partners. When you click an outbound discount link, copy a promo code, or redeem an offer through our Platform, Provider may receive an affiliate referral commission or promotional fee from the merchant at no additional cost to you.
Provider has no control over third-party merchant websites, privacy practices, terms of sale, or return policies. Your interactions with merchant websites are governed solely by those merchants' respective terms.
5. Prohibited Platform Use & Scraping Controls
You expressly agree NOT to engage in any of the following restricted activities:
- Reselling, sublicensing, scraping, or publicly republishing gated promo codes unlocked through the Platform.
- Utilizing automated crawlers, bots, scrapers, data extraction scripts, or automated tools to harvest content from the Platform without prior written consent.
- Attempting to bypass, disable, reverse-engineer, or circumvent security mechanisms, verification tokens, or access controls.
- Impersonating any individual, public official, military service member, or entity.
6. DISCLAIMER OF WARRANTIES
THE PLATFORM, VERIFIED DISCOUNT DIRECTORY, PROMO CODES, AND SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, PROVIDER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, NON-INFRINGEMENT, OR FREEDOM FROM COMPUTER VIRUSES OR MALICIOUS CODE. PROVIDER DOES NOT WARRANT THAT PROMO CODES WILL BE ACCEPTED BY MERCHANTS, THAT PRICES WILL BE ACCURATE, OR THAT PLATFORM ACCESS WILL BE UNINTERRUPTED OR ERROR-FREE.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MILPERK, ITS PARENT ENTITIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, SAVINGS, DATA, GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PLATFORM, UNACCEPTED PROMO CODES, OR THIRD-PARTY MERCHANT TRANSACTIONS, REGARDLESS OF LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PROVIDER'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
8. Indemnification
You agree to defend, indemnify, and hold harmless MilPerk, its officers, directors, employees, contractors, and affiliates from and against any third-party claims, liabilities, damages, losses, expenses, or legal fees arising out of or related to your breach of these Terms, your misuse of the Platform, or your violation of any applicable law or third-party rights.
9. Governing Law & Binding Individual Arbitration
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively through mandatory, binding individual arbitration administered by the American Arbitration Association (AAA). YOU AND PROVIDER AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
10. Severability, Termination & Modifications
We reserve the right to terminate or suspend your account and access to the Platform immediately, without prior notice, for any violation of these Terms. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
